Terms of Service
These Terms of Service govern access to and use of QuestAI Study, QuestAI Core AI infrastructure, virtual key services, and academic learning tools by institutions, educators, and students.
1. Agreement & Defined Terms
By registering an account, authenticating via Single Sign-On (SSO), or accessing QuestAI Study and QuestAI Core (collectively, the "Platform"), you (as an individual student, parent/guardian, educator, or authorized school administrator) agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our Data Governance Protocols.
Key Definitions:
- QuestAI Study: The web application, learning management system, timetable sprint coordinator, assessment drafting environment, and student revision workspace.
- QuestAI Core: The internal AI orchestration gateway, virtual key validation engine, and multi-provider failover router operated by QuestAI.
- AI Provider: Approved commercial third-party cloud infrastructure vendors (e.g. Google Cloud Gemini API paid tiers, OpenRouter enterprise accounts) providing model inference under enterprise data protection terms.
- Virtual API Key: Internal, scoped, revocable cryptographic tokens issued by QuestAI Core to authorize platform components to access AI learning features.
- Institution: A registered primary, secondary, or tertiary educational school, department, or academy subscribing to or licensing the Platform.
2. Service Scope & Educational Role
QuestAI Study provides structured revision planning, timetable-aware exam sprints, spaced repetition cues, drafting scaffolds, topic mastery analytics, and formative curriculum-grounded AI assistance.
QuestAI functions solely as an assistive educational tool. QuestAI is not an accredited secondary schooling authority or exam board. Official academic grades, report cards, and course accreditations remain exclusively within the authority of the enrolled school and jurisdictional educational bodies (e.g. QCAA).
3. User Accounts, Authentication & Security
- Credential Safeguards: Users are responsible for maintaining the confidentiality of their login credentials and SSO access tokens. Unauthorized access must be reported immediately to school administrators or QuestAI.
- Accurate Enrollment Data: Users agree to maintain accurate profile information, year levels (Years 7–12), and subject enrolments.
- Non-Transferability: Accounts are assigned to individual students or educators and must not be shared, pooled, or transferred across multiple individuals.
4. Acceptable Use Policy & Upstream Compliance
Users must adhere to strict academic honesty and responsible platform usage. You expressly agree NOT to:
- Use AI study integrations for academic misconduct, contract cheating, plagiarism, or attempting to bypass institutional assessment integrity rules.
- No Raw API Resale or Proxying: Virtual API Keys and QuestAI Core endpoints are strictly for powering QuestAI educational workflows. You may not resell, sub-license, reverse-proxy, or commercially redistribute raw model access or use the service to build competing raw model APIs.
- Attempt to reverse engineer, decompile, scrape, bulk extract, or download source code, prompt libraries, or underlying curriculum datasets from the Platform.
- Upload or transmit malicious code, viruses, or materials that violate intellectual property, privacy, or moral rights of any third party.
- Place an unreasonable or disproportionate load on the Platform's infrastructure, servers, or upstream AI provider rate limits.
Violation of this Acceptable Use Policy may result in immediate account deactivation, revocation of virtual keys, and notification to school authorities.
5. Intellectual Property & User Content Ownership
Students and subscribing schools retain all rights, title, and intellectual property in and to their uploaded essays, notes, homework solutions, task sheets, and study drafts.
You grant QuestAI a limited, non-exclusive, royalty-free license solely to host, parse, format, display, and process your content as strictly required to deliver platform functionality.
6. QuestAI Core Infrastructure, Model Routing & Gateway Terms
QuestAI Core operates as the internal AI orchestration gateway and policy router connecting QuestAI Study to approved third-party AI infrastructure providers. Under these Terms:
- Upstream Provider Routing: QuestAI Core routes requests to approved commercial third-party AI providers (including Google Cloud Gemini API paid billing projects and OpenRouter enterprise accounts) under contractual non-training and data protection terms.
- Dynamic Model Selection & Failover: QuestAI Core may dynamically change, update, or substitute the selected provider or model, and may execute automated failover when a provider is degraded, unavailable, or capacity is exhausted.
- No Model Guarantee: QuestAI does not guarantee that a specific upstream model, version, or provider will be utilized for any specific request or feature.
- Fail-Closed Safety: QuestAI Core reserves the right to refuse or cancel request routing where no available provider meets required safety, policy, or student privacy standards.
- Credential Isolation: All upstream provider credentials, billing keys, and API secrets are managed exclusively by QuestAI Core and remain strictly hidden from and inaccessible to end users.
- Quotas & Rate Limits: QuestAI Core may enforce per-user, per-grade, or per-school quotas, token limits, and concurrency caps to protect platform availability and ensure equitable service delivery.
7. AI Assistive Features, Verification & Academic Disclaimer
QuestAI embeds AI capabilities designed to provide formative explanations, concept breakdowns (Feynman models), flashcard generation, and study timetables.
- Assistive Study Aid & Verification: AI outputs are advisory tools intended to support independent learning. AI models may occasionally generate incomplete or inaccurate explanations. Students and educators remain solely responsible for reviewing and verifying the academic correctness of AI-assisted outputs.
- No Academic Outcome Guarantee: QuestAI makes no warranty or representation that using the Platform or AI features will result in specific test scores, exam results, or ATAR achievements.
8. Age Requirements & School/Parental Authorization
QuestAI Study is intended for secondary school students (typically ages 12–18) and adult educators. Where students are under 18 years of age, access is provisioned either through their participating educational institution (which obtains necessary parental or guardian consents under school enrolment policies) or with direct parental authorization.
9. Public Advertising & Third-Party Services
To support free access to public educational articles and resources, QuestAI may display contextual or non-personalized advertisements (e.g. through Google AdSense) on public, non-authenticated pages.
Authenticated Student Areas: All logged-in student portals, teacher dashboards, and institutional workspaces are completely ad-free. No student coursework, grades, or personal information is shared with advertising networks.
10. Account Suspension & Termination
QuestAI or your school administrator may suspend or terminate account access at any time for violation of these Terms, academic misconduct, or upon conclusion of your school's subscription.
You may terminate your account at any time via school administration. Upon termination, access ceases and data is permanently purged within 14 business days in accordance with our Data Governance Protocols.
11. Institutional Departures & Data Portability
Upon expiry or termination of an Institutional subscription, schools are provided a 30-day transition window to export student records, progress reports, and assessment rubrics in standard open formats (DOCX, JSON, CSV) before data is queued for permanent purging.
12. Disclaimer of Warranties
To the maximum extent permitted by applicable law, QuestAI Study, QuestAI Core, and all related services, content, and AI features are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular academic purpose, non-infringement, or uninterrupted availability.
13. Limitation of Liability
To the maximum extent permitted by law, QuestAI and its operators, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of academic opportunity, or study disruption. In all cases, QuestAI's total cumulative liability arising out of or related to these Terms shall not exceed the amount actually paid by you or your institution in the twelve (12) months preceding the claim, or AUD $100, whichever is greater.
14. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Queensland, Australia, without regard to its conflict of law provisions. The parties irrevocably submit to the non-exclusive jurisdiction of the courts located in Queensland, Australia.
15. Changes to Terms & Contact
We may update these Terms from time to time to reflect regulatory changes or new platform features. Notice of material changes will be provided via platform notifications or school administrator notices.
